Arbitration (Arbitrator’s and Administration fees)

A. Domestic Arbitration

1. Arbitrators Fees

1.1. Sole Arbitrator

For arbitration conducted by the sole arbitrator in pursuant to and administrated under the Centre’s guidance, the fee calculated in accordance with the schedule below is the maximum amount of payable to each arbitrator.

1.2. Arbitral Tribunal’s Fees (Each)

For arbitration conducted pursuant to and administrated under the Centre’s guidance, the fee calculated in accordance with the schedule below is the maximum amount of payable to each arbitrator.

1.3. Substitution of Arbitrator(s)

The Centre will determine the substitute and substituted arbitrator’s fee as follows:

  • 90 percent to substitute arbitrator 10% to the substituted arbitrator after 1st hearing;
  • 80 percent to substitute arbitrator 20% to the substituted arbitrator after 2nd hearing;
  • 70 percent to substitute arbitrator 30% to the substituted arbitrator after 3rd hearing; and
  • 50 percent to substitute arbitrator 50% to the substituted arbitrator after 4th hearing onwards;

2.  Cost of Arbitration/ Administration fees

The administration fees calculated below shall apply to all arbitrations administered by the Centre and the maximum amount payable to the Centre.

B. International / Overseas Parties (Interim Fees, Approved from the National Judicial Commission of Bhutan until further revision)

1. Arbitrator’s Fee (Each)

1.1 Administration Fee

The Above Arbitrator’s and Administration fees for International arbitration do not include the following:

  • Applicable Taxes
  • Cost for logistic and Printings of documents
